Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Hydratelo, a brand of The Nelson M Group LLC ("Hydratelo," "we," "us"). They govern your use of hydratelo.com and related services, for example email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If these Terms are not acceptable to you, do not use the Services.

What Hydratelo is, and is not

Hydratelo is an information service. We publish general, plain-language details about health and beauty topics, and let visitors opt in to related updates. We do not sell products or treatments, make medical claims, give medical advice, diagnose or treat any condition, match people with clinicians, retailers, or service providers, or refer people to providers, and we do not share your details with clinicians, retailers, or other partners.

• Decisions about your skin, hair, body, and routine are yours. Reading our content does not obligate you to do anything.
• The clinician, retailer, or brand you deal with, not Hydratelo, sets its own products, prices, and advice and is responsible for its own work and decisions.
• Skin, hair, products, and results vary from person to person. We will not guarantee that any habit, ingredient, or product will work, cost or save any amount, or turn out any particular way.

Eligibility

You need to be 18 or older, located in the United States, and able to form a binding contract before using the Services, and the data you submit must be your own or that of a person who authorized you to submit it.

Your information and accuracy

You agree to give accurate and current information and to update it if it changes. You may only provide a mobile number that you own or are authorized to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

Communications and text-message consent

If you choose to opt in, you consent to being contacted by email and, if you tick the boxes that apply, by automated text messages as set out in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. Acceptable use

You must not: (a) enter false or misleading details, or another person's details; (b) use the Services for anything unlawful, fraudulent, or abusive; (c) interfere with the Services or try to gain access you are not allowed; (d) submit forms with bots or other automated tools; (e) copy, scrape, or resell our content without our permission; or (f) pretend to be someone else. We may suspend or end your access if you do any of these.

Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, manufacturers, or nonprofit organizations) are run by third parties. We never endorse any product, brand, or provider and are not responsible for the conduct, content, or results of third parties. Your relationship with a retailer, brand, or health professional is between you and them.

Intellectual property

The Services, including the Hydratelo name, logo, text, graphics, and design, are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial reasons.

Disclaimers

We provide the services and all content "as is" and "as available" and disclaim all warranties, express or implied, among them implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation, or the delivery (or timely delivery) of any message.

Hydratelo does not provide medical, professional, legal, or financial advice, and makes no representation about any product, ingredient, result, or health outcome.

Limitation of liability

To the maximum extent the law permits, Hydratelo and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health, beauty, or product decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Certain jurisdictions do not permit some limitations, so part of the above may not apply to you. These Terms do not limit any liability that the law does not allow to be limited.

Indemnification

You agree to hold The Nelson M Group LLC, its affiliates, and its personnel harmless, and to indemnify them, for claims, damages, and expenses (reasonable attorneys' fees included) arising from your violation of these Terms, from misuse of the Services, or from giving a phone number or other information that you were not authorized to provide.

Disputes, governing law, and arbitration

Informal resolution first. Before you file any claim, reach us at [email protected] and give us a 30-day window to try to settle it.

Binding arbitration. Excluding small-claims matters and claims for injunctive relief for intellectual-property misuse, any dispute between you and Hydratelo or The Nelson M Group LLC about these Terms or the Services is to be resolved by final and binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules. You may elect to hold it in your county of residence or by video or phone. The arbitrator may grant individual relief equal to what a court could, and judgment may be entered in any court of competent jurisdiction.

Class-action waiver. To the extent permitted by law, you and Hydratelo each agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative action.

Opt-out. You can opt out of arbitration within 30 days of your first acceptance of these Terms by emailing [email protected] and state "Arbitration Opt-Out" in the subject line, along with your name and mobile number.

Governing law. We interpret these Terms under the Federal Arbitration Act and the laws of the state where The Nelson M Group LLC has its principal place of business, ignoring conflict-of-law rules. The state and federal courts based there have exclusive jurisdiction, subject to the arbitration clause.

Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. We may suspend or end your access at our discretion, including if you violate these Terms. Any section that by its nature should continue (such as disclaimers, limitation of liability, indemnification, and disputes) will survive termination.

Changes

Updates to these Terms will be posted with a new "Last updated" date. Using the Services after the effective date means accepting the updated Terms. If a change is material, we will notify you as needed by law.

General

This is the entire agreement between you and us on this subject: these Terms plus the Privacy Policy and SMS Terms. The remainder survives if any part is unenforceable; failing to enforce a provision does not waive it. You need our consent to assign these Terms, while we may assign them in a merger or a sale of the business.
